1. This agreement

These terms are an agreement between you and Braza Holding, which operates Guitar PS. By creating an account you accept them and the Privacy Policy. If you are using Guitar PS on behalf of an organisation, you confirm you may bind it.

Guitar PS is free. There is no paid tier, no trial and no payment, so nothing here obliges you to pay us anything.

2. Your account

You must be old enough to enter this agreement in your country and to consent to data processing there. Keep your password to yourself, use one you do not reuse elsewhere, and tell us if you think someone else has access.

You are responsible for what happens under your account, except where the law says otherwise or where the cause was our own failure.

3. Your content, and the licence you give us

You keep ownership of every tab, score and chord chart you create or upload. We claim nothing.

For private drafts, you grant us a limited licence to host, copy, process and display that content solely so we can operate the service for you.

When you choose to publish an item, you additionally grant us and other signed-in users a non-exclusive, worldwide, royalty-free licence to host, copy, process, view, play, practise and display that item only inside Guitar PS, for as long as it stays published. That licence ends when you unpublish or delete the item, except for copies already held in backups and records we must retain to resolve disputes or defend legal claims.

Publishing is optional and is not required to use the library. Private drafts are visible only to you. Published items are visible only to signed-in Guitar PS users: they are not public web pages, are not made available to anonymous visitors, are marked against search-engine indexing and are not used as song-specific marketing pages.

Before each publication, you must actively confirm that you created the music or have every permission and right needed to share it. We record the account, item, date, time and declaration version. A transcription, arrangement, tablature, chord chart or score of someone else’s song may still require permission even if you made the transcription yourself.

By publishing, you represent and warrant that the item and our permitted use of it do not infringe copyright, moral rights, privacy, publicity, trademark or any other right. You remain responsible for the content and for obtaining every licence, consent and permission the law requires.

4. Published content and the shared library

Published items are supplied by users. We do not pre-screen them, verify their accuracy, or check their licensing. The community vote is a signal from other players, not a guarantee from us.

Do not publish material you have no right to distribute, material that is unlawful, or material designed to harass someone. We may immediately unpublish, restrict or remove content while we investigate a credible complaint, court order, legal duty or breach of these terms. Where appropriate, we will tell you why and may restore the item after the issue is resolved.

We may preserve the publication declaration, complaint, supporting evidence and enforcement decision after an item or account is deleted where reasonably necessary to resolve a dispute, comply with law or establish, exercise or defend legal claims.

Repeated or serious infringement may result in loss of publishing access or account suspension. We apply these measures proportionately and do not limit any consumer right that cannot lawfully be limited.

5. Copyright reports

If you believe an item infringes your rights, send us the URL or item identifier, identify the protected work, explain your relationship to the rights, provide a way to contact you and state in good faith why the use is not authorised. Email legal@guitarps.com. Do not send sensitive identity documents unless we specifically and lawfully need them.

We will review sufficiently detailed reports, may ask for clarification, may notify the user who published the item and may restrict or remove the item. A user may respond with evidence of ownership, a licence or another lawful basis. We do not decide ownership disputes that require a court or competent authority.

Nothing in these terms prevents us from complying with a valid court order, applicable notice-and-takedown rule or another legal obligation. Nothing in these terms makes us the owner, author, publisher or endorser of user content.

6. Acceptable use

Do not attempt unauthorised access, disrupt the infrastructure, introduce malicious code, scrape at a scale that degrades the service for others, evade limits, or use Guitar PS to harm another person.

7. What belongs to us

The Guitar PS software, brand, interface and original exercises are ours. Open-source components and the third-party audio samples in the instrument banks remain under their own licences, which are listed in the repository.

8. Warranties and liability

Guitar PS is an educational tool. It is not medical advice about hearing damage, repetitive strain or any other health matter. If something hurts, stop playing and speak to a professional.

The service is provided as is and as available. Because Guitar PS is free, our liability to you is limited to the maximum extent the law permits. Nothing here excludes liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be excluded.

If you are a consumer, your statutory rights are unaffected by anything in these terms. Brazilian consumers keep every right under the Código de Defesa do Consumidor.

9. Ending it

You can delete your account at any time in Settings, which removes your data on the schedule in the Privacy Policy.

We may suspend or close an account for a serious breach of these terms, a security threat or a legal requirement. Except where the law or an active threat prevents it, we will tell you first and give you a chance to export your data.

10. General

If one provision turns out to be unenforceable, the rest survives. Not enforcing a term once does not waive it.

We may transfer this agreement as part of a merger or acquisition; you may not transfer it without our consent. Where the law of your home country gives you mandatory rights or a local forum, those apply regardless of anything here.

We will announce material changes to these terms inside the app before they take effect.
